1. Acceptance

By accessing and using the Noctal website at noctalj.pro or by submitting an enquiry, you agree to be bound by these terms. If you do not agree, please do not use this site.

2. What Noctal offers

Noctal provides business advisory, workflow design, model evaluation and team education programmes for organisations in Malaysia. The services are B2B in nature. Nothing on this site constitutes legal, financial, medical or regulatory advice, and the information published here is for general informational and commercial purposes only.

Programme descriptions and prices on this site are indicative. Confirmed scope, pricing and timelines are set out in a written engagement proposal or statement of work agreed between Noctal and the client before work commences.

3. Eligibility and user conduct

This site is intended for business professionals and organisations. By using it, you represent that you are acting in a business capacity and are of legal age to enter into commercial agreements in your jurisdiction. You agree to use the site only for lawful purposes and in ways that do not infringe the rights of others or restrict the use of this site by third parties.

4. Enquiries and engagements

Submitting an enquiry through the contact form does not create any contractual obligation on either side. A commercial engagement begins only when both parties have agreed in writing to a defined scope and fee. Prices on the site are stated in Malaysian Ringgit (RM) and are exclusive of SST where applicable.

5. Cancellations and changes

Terms covering cancellations, rescheduling and payment are set out in the engagement proposal or statement of work agreed for each programme. Where a client needs to cancel or reschedule, Noctal will work to accommodate reasonable requests. Fees already incurred for work completed prior to cancellation are not refundable unless otherwise agreed in writing.

6. Intellectual property

All text, design, code and other material on this website is the property of Noctal or its licensors. You may not reproduce, distribute or create derivative works from site content without prior written permission. Deliverables produced as part of a paid engagement are governed by the intellectual property terms in the relevant engagement proposal.

7. Acceptable use

You must not use this site to transmit unsolicited communications, attempt to access systems or data you are not authorised to access, introduce malicious code or interfere with the operation of the site. Noctal reserves the right to restrict access to any person who misuses the site.

8. Disclaimers and limitation of liability

This site and its content are provided on an "as available" basis. Noctal makes no representations that the information is complete, accurate or current. To the extent permitted under the laws of Malaysia, Noctal's liability for any claim arising from use of this site is limited to direct losses actually caused by our negligence and shall not in any event exceed the fees paid under the relevant engagement, if any.

Noctal is not liable for indirect, consequential or business losses arising from reliance on information published on this site.

This site may contain links to third-party websites. These are provided for reference only. Noctal does not endorse or take responsibility for the content, privacy practices or reliability of any third-party site.

10. Governing law

These terms are governed by the laws of Malaysia. Any disputes arising from these terms or from use of this site shall be subject to the jurisdiction of the courts of Malaysia.

11. Changes to these terms

Noctal may revise these terms at any time. The date at the top of this page shows when they were last changed. Continued use of the site after a revision constitutes acceptance of the updated terms.
